POP GOES THE MONKEY - PAYMENTS, REFUNDS AND RETURNS

EFFECTIVE JUNE 13TH, 2026

 

The products sold on the Pop Goes the Monkey site are not produced or shipped by our staff or employees. We utilize multiple third-party production partners to print and ship each order placed on our site to our customers. Payments for these orders are processed through Shopify, Inc. and by Pop Goes the Monkey on your behalf to our vendors. This allows us to offer thousands of unique, high-quality products without the tremendous cost of carrying inventory.

To fulfill orders as efficiently as possible, our production partners review orders throughout the week, group similar-sized items together, and sometimes schedule separate print runs across multiple printers. This process helps us keep costs down while maintaining the quality and accuracy of every order.

Because each order may be processed in stages, some items may be printed within hours of purchase, while others may take a day or two. Since this workflow is not fully automated, our team also plays an active role in overseeing each order to help ensure everything is produced correctly.

To keep production on schedule and ensure orders are delivered as quickly as possible, we require a confirmed list of bespoke items promptly after an order is placed. As a result, our ability to change, combine, cancel, or otherwise modify an order is extremely limited.

Upon successful completion of payment, the order shall be deemed final. Any exception to this policy may be granted solely at the discretion of Pop Goes the Monkey staff.

Because all products are custom-printed for each customer at the time of order, Pop Goes the Monkey does not offer refunds or accept returns based on customer dissatisfaction, change of mind, or any other reason unrelated to fulfillment error, damage, or misprint. Refunds or returns will be considered only where Pop Goes the Monkey has made an error in fulfilling the order or where the item is received in a damaged or misprinted condition. For the avoidance of doubt, apparel that conforms to the order as submitted but does not fit shall not be deemed damaged, defective, or misprinted and shall not qualify for refund or return.

For the reasons set forth above, our products, including digital assets, are exempt from the requirements of EU Directive 2023/2673, including any obligation to provide a 14-day withdrawal period or a “Cancel Contract” mechanism. As a condition of purchase, you are required to affirmatively acknowledge at checkout that you accept these terms and waive any applicable right of withdrawal once payment has been processed.

Notwithstanding the foregoing, Pop Goes the Monkey reserves the right, in its sole discretion, to review and resolve customer concerns on a case-by-case basis.

If you receive an item that is damaged, misprinted, or incorrectly fulfilled, you must notify Pop Goes the Monkey by email within fourteen (14) days of the date of delivery. Pop Goes the Monkey will not accept returns or issue refunds, where otherwise permitted under these Terms, unless notice is provided by email to help@popgoesthemonkey.com within the required time period.

In connection with any such claim, Pop Goes the Monkey may require additional information, documentation, or photographs sufficient to verify the alleged damage, misprint, or fulfillment error. In certain cases, Pop Goes the Monkey may also require the return of the item as a condition of review. Where a return is required, Pop Goes the Monkey will reimburse reasonable return shipping costs or provide a return shipping label.

Upon receipt of all information and materials reasonably required to evaluate the claim, Pop Goes the Monkey shall, in its sole and exclusive discretion, either: (a) ship a replacement product; or (b) issue a full refund to the original method of payment in the amount of the original purchase price and any original shipping charges paid.

Your purchase price includes the price of the product(s) ordered, along with any applicable sales tax or regional tax that Pop Goes the Monkey is required and able to collect. Please note that there may be additional duties, taxes, customs charges, import fees, brokerage fees, or similar charges that apply to your order that we are not able to calculate, collect, or identify in advance. These charges, if applicable, are the responsibility of the customer.

Sales tax is calculated based on the shipping address provided and the tax rate in effect at the time your order is processed. In jurisdictions where Pop Goes the Monkey does not collect and remit sales tax, you may be responsible for paying applicable use tax. We do not make any representations regarding whether use tax applies to your purchase, and you are responsible for determining and paying any such tax where required.

If a shipment is returned to our production facilities because it was unclaimed or because the shipping address provided was incomplete, inaccurate, or otherwise invalid, we will try to contact you using the email address associated with your account to arrange reshipment to a new or corrected address. Any reshipment will be subject to an additional shipping fee.

If we are unable to reach you or do not receive a response within thirty (30) days, the order may be treated as unclaimed. Items designated as unclaimed may be destroyed or otherwise disposed of by the production facilities without further notice.

Any reprint, replacement, or refund for an order believed to have been lost in transit will be considered on a case-by-case basis at the discretion of Pop Goes the Monkey and its production partners. Decisions will be made only after reviewing the available tracking history and any relevant communication with the shipping carrier.

Pop Goes the Monkey reserves the right to refuse, limit, or cancel any order if we reasonably believe that the order is fraudulent, unauthorized, illegal, or otherwise violates these Terms of Service. We take these steps to help protect both our customers and our business from fraud and other unauthorized or unlawful activity. We may cancel an order at any time during the fulfillment process, including after an order confirmation has been issued. We also reserve the right, in our sole discretion, to limit or cancel any order containing pricing errors or other inaccuracies, or where circumstances reasonably suggest that the order was submitted or processed through fraudulent means.

If we cancel an order after payment has been processed but before any items in the order have been produced, we will issue a full credit or refund to the original payment method. If any items have already been produced before cancellation, payment for those items will be non-refundable.

Pop Goes the Monkey reserves the right to investigate any claim for refund, replacement, chargeback, or other relief where we reasonably suspect fraud, abuse, misrepresentation, or other bad-faith conduct. By placing an order on our site, you agree to cooperate with any reasonable request for information, documentation, photographs, or return of merchandise necessary to review your claim. Where we determine, in our sole discretion, that a claim is fraudulent, intentionally misleading, or otherwise made in bad faith, we may deny the claim, refuse future service, cancel pending orders, and pursue any remedy available to us under applicable law, including civil recovery, chargeback disputes, referral to payment processors or law enforcement, and recovery of associated costs, fees, and damages to the fullest extent permitted by law.
